JOHN MacGIFFERT, LEED AP, PMP President
Mr. MacGiffert provides forensic
consulting for construction defect claims, environmental claims, and catastrophic
insurance loss claims. He also provides LEED® Accredited Professional
consulting services in support of the US Green Building Council’s various
LEED certification programs. In addition, Mr. MacGiffert has recently
developed a Sustainable Redevelopment business segment by applying his
energy and environmental background and experience.
Mr. MacGiffert also serves
as an author and instructor for the professional development of Professional
Architects, Engineers, and Contractors throughout the country. The
current courses that Mr. MacGiffert teaches include Power Engineering,
Sustainable Design, Disaster Recovery and Design, Construction Trends,
Design/Build, Solving Water Intrusion and Mold Problems in North Carolina,
Toxic Mold, Construction Claims Avoidance, High Performance Project Management,
Construction Contracting, Risk Management, and Managing Construction Claims
and Disputes.
PROJECT EXPERIENCE:
Texas, Hurricane Ike damage
and reconstruction assessment. Mr. MacGiffert was a team leader
in charge of the assessment of damage due to Hurricane Ike on numerous
institutional, commercial and residential properties as an independent
building consultant. Mr. MacGiffert’s team performed damage assessments
and reconstruction estimates utilizing Xactimate v25 software for 131 buildings
with $74.6 million in losses resulting from Hurricanes Ike. The types of
properties assessed included several churches, an entire school district,
hospitals, high rise office buildings, hotels, retail plazas and malls,
commercial warehouses, apartment complexes, and residences.
University of South Florida
Holly Apartments, Moisture Intrusion Claim. Mr. MacGiffert led
an analysis to determine the impact of moisture intrusion associated with
a 12 building University student living community design-build project
performed by Beers/Skanska. The project was comprised of seven-three
and four story apartment buildings and five community service buildings
at the University of South Florida’s main Tampa Campus. The effort led
by Mr. MacGiffert culminated by legal action that involved the prime contractor
and twenty of its subcontractors attempted to settle an eight year dispute
between the university and the prime contractor over various sources of
moisture intrusion. Mr. MacGiffert’s and his team identified the defect
sources, performed destructive testing to confirm causation, and prepared
an estimate to repair the damages.
Legacy Key Apartments,
Fire Damage Insurance Claim. Mr. MacGiffert led an effort to
prepare an analysis of potential fraud on the part of a general contractor
against a major insurance company. The case involved alleged overcharges
due to code upgrades on the replacement of a 12-unit three story apartment
building located in Atlanta, GA after it was damaged by fire. The analysis
included the preparation of a complete restoration estimate, interpretation
and application of building code requirements and a detailed comparative
analysis to the contractor’s estimates.
Borujerdi Appraisal, Ft.
Lauderdale, FL. Mr. MacGiffert served as the appraiser representing
Chubb Insurance on this luxury coastal residence. The claim involved flooding
of the residence from a plumbing leak after which the owner requested replacement
of all marble flooring within the home due to alleged moisture damage.
Mr. MacGiffert’s written appraisal of the damage concluded that the marble
flooring could be cleaned and replacement could be avoided. Mr. MacGiffert’s
assessment was upheld by the court assigned umpire that heard the case
resulting in a savings of over a half million dollars.
Gulf Coast and Southeast
Florida, Hurricane Katrina and Wilma Insurance Claims. Mr. MacGiffert
was a team leader in charge of the assessment of hurricane damage on numerous
commercial and residential properties for a major insurance company for
a period of over one year. Mr. MacGiffert’s team performed insurance claim
damage assessments and loss estimates for 51 projects that totaled $25.5
million in losses resulting from Hurricanes Katrina and Wilma. The types
of properties assessed included major shopping malls, strip mall shopping
plazas, commercial warehouses, offices and retail centers, industrial processing
plants, stores, funeral homes, Yacht clubs, apartment complexes, hotels,
high rise office buildings, and single family residences ranging from luxury
homes to historical landmark homes. Each project assessment included an
assessment of the extent of damage, the scope of necessary repairs, an
estimate for the cost to complete the repairs, flood vs. wind damage, an
estimate of time to repair the total and wind only portions of the loss,
and a determination as to the habitability of the property during the period

Escambia County School
Board, Florida, Hurricane Ivan Insurance Claim. Mr. MacGiffert
performed insurance claim damage assessments and loss estimates for 75
schools totaling $44 million resulting from Hurricane Ivan. The primary
focus of Mr. MacGiffert’s effort was the assessment of moisture intrusion
and mold remediation. Estimates for mold remediation and reconstruction
were prepared for each school that incurred significant damage. Mr. MacGiffert
participated in the negotiations between the school board and several insurance
companies that provided coverage.
Certain Underwriters v
G&G, Port Gibson, Mississippi, Theft Insurance Claim. Mr. MacGiffet
conducted a damage assessment associated with a copper theft and damage
case involving mechanical equipment, refrigeration systems and equipment,
and electrical circuits and systems at a grocery store in Mississippi.
Pepsi Bottling Plant,
Palm Beach, Florida, Tornado Insurance Claim. Mr. MacGiffert performed
onsite construction management services primarily focused on assessing
damage to all electrical systems, process line equipment, HVAC systems
and building components. The assignment objective was to enhance productivity
to improve schedule performance for business interruption insurance claim
resulting from a tornado strike for Chubb Group of Insurance Companies.
Mr. MacGiffert developed a CPM schedule, developed progress tracking methodologies
and monitored and negotiated the cost of the project with the general contractor
and various subcontractors.
Minneapolis Federal Reserve
Bank, Asbestos Lawsuit. Mr. MacGiffert performed a cost and schedule
analysis of the asbestos abatement of this landmark facility for Scheher
& Associates and served as expert witness for litigation.
Ocean Trail Convalescent
Center, North Carolina, Mold Arbitration. Mr. MacGiffert prepared a
cost analysis associated with a mold remediation arbitration claim for
Patterson, Dilthey, Clay, Bryson & Anderson on behalf of the contractor
who performed the construction of this nursing home and healthcare facility.

in 1987, Mr. MacGiffert was instrumental in developing this highly professional
and ethical corporation which became 75% market driven through relationships.
Mr. MacGiffert was responsible for the overall direction and profitability
of this environmental remediation firm and also coordinating strategic
operational and marketing priorities for the company’s expansion of services
throughout the Southeastern U.S. The markets served by Lang
include utilities, industrial facilities, military bases, state owned facilities,
municipalities, commercial buildings, hospitals, airports and schools.
The company’s service areas include indoor air quality improvement, asbestos
removal, lead abatement and hazardous material remediation.

the company’s scope of services from asbestos abatement into mold remediation,

protecting the quality of work standards that had long been established.
Stanton Energy Center, comprehensive
construction claim.
Mr. MacGiffert was employed
as an independent consultant for Thelen, Martin, Johnson and Bridges at
the Stanton Energy Center responsible for overseeing the preparation of
a comprehensive claim for a major mechanical and piping contract. Immediately
prior to this assignment, Mr. MacGiffert served as the Field Cost and Schedule
Supervisor for Bechtel Power Corporation while executing this contract.
Through the preparation of a comprehensive construction claim which led
to litigation, Mr. MacGiffert helped the contractor successfully recovered
$9 million in additional revenue on a base contract value of $17 million.

Gaithersburg, MD
Began employment with Bechtel
as a mechanical estimator and progressed to Contracts Manager over a ten
year period immediately after graduating from Clarkson University.
