MacMS was a team leader
in charge of the assessment of damage due to Hurricane Ike on numerous
institutional, commercial and residential properties as an independent
building consultant. MacMS’s team performed damage assessments and reconstruction
estimates utilizing Xactimate v25 software for 131 buildings with $74.6
million in losses resulting from Hurricanes Ike. The types of properties
assessed included several churches, an entire school district, hospitals,
high rise office buildings, hotels, retail plazas and malls, commercial
warehouses, apartment complexes, and residences.

Appraisal, Ft. Lauderdale, FL.
MacMS served as the appraiser
representing Chubb Insurance on this luxury coastal residence. The claim
involved flooding of the residence from a plumbing leak after which the
owner requested replacement of all marble flooring within the home due
to alleged moisture damage.
MacMS’s written appraisal
of the damage concluded that the marble flooring could be cleaned and replacement
could be avoided.
MacMS’s assessment was upheld
by the court assigned umpire that heard the case resulting in a savings
of over a half million dollars. |

the damage to all of their facilities after a dispute arose between the
school district and their insurance adjuster about damages caused by Hurricane
Ike.
Assessment of property damage

for 31 facilities while occupied took six months. Total estimated damage
to the property exceeds $40 million. |

MacMS led an analysis to
determine the impact of moisture intrusion associated with a 12 building
University student living community design-build project performed by Beers/Skanska.
The project was comprised of seven, three and four story apartment buildings
containing 732 bedrooms and five community service buildings at the University
of South Florida’s main Tampa Campus. The effort led by MacMS culminated
by legal action that involved the prime contractor and twenty of its subcontractors
attempted to settle an eight year dispute between the university and the
prime contractor over various sources of moisture intrusion. MacMS’s and
his team identified the defect sources, performed destructive testing to
confirm causation, and prepared an estimate to repair the damages. Legacy

an analysis of potential fraud on the part of a general contractor against
a major insurance company. The case involved alleged overcharges
due to code upgrades on the replacement of a 12-unit three story apartment

included the preparation of a complete restoration estimate, interpretation
and application of building code requirements and a detailed comparative
analysis to the contractor’s estimates. |

International to determine the magnitude of damages created by the owner’s
construction manager and its subcontractors on this large self-contained
community project.
The termination of the contractor
turned into a lawsuit among the parties for which the owner was seeking
to recover its cost to complete plus damage due to negligent construction.
The project involved the determination of cost and schedule damages due
the owner. |

Florida, Hurricane Katrina and Wilma Insurance Claims.
MacMS was a team leader
in charge of the assessment of hurricane damage on numerous commercial
and residential properties for a major insurance company for a period of
over one year. MacMS’s team performed insurance claim damage assessments
and loss estimates for 51 projects that totaled $25.5 million in losses
resulting from Hurricanes Katrina and Wilma. The types of properties assessed
included major shopping malls, strip mall shopping plazas, commercial warehouses,
offices and retail centers, industrial processing plants, stores, funeral
homes, Yacht clubs, apartment complexes, hotels, high rise office buildings,
and single family residences ranging from luxury homes to historical landmark
homes. Each project assessment included an assessment of the extent of
damage, the scope of necessary repairs, an estimate for the cost to complete
the repairs, flood vs. wind damage, an estimate of time to repair the total
and wind only portions of the loss, and a determination as to the habitability
of the property during the period of repairs.

Escambia County School
Board, Florida, Hurricane Ivan Insurance Claim.
MacMS performed insurance
claim damage assessments and loss estimates for 75 schools totaling $44
million resulting from Hurricane Ivan. The primary focus of MacMS’s effort
was the assessment of moisture intrusion and mold remediation. Estimates
for mold remediation and reconstruction were prepared for each school that
incurred significant damage. MacMS participated in the negotiations between
the school board and several insurance companies that provided coverage.

Mr. MacGiffet conducted
a damage assessment associated with a copper theft and damage case involving
mechanical equipment, refrigeration systems and equipment, and electrical
circuits and systems at a grocery store in Mississippi.
Pepsi Bottling Plant,
Palm Beach, Florida, Tornado Insurance Claim.
MacMS performed onsite construction
management services primarily focused on assessing damage to all electrical
systems, process line equipment, HVAC systems and building components.
The assignment objective was to enhance productivity to improve schedule
performance for business interruption insurance claim resulting from a
tornado strike for Chubb Group of Insurance Companies. MacMS developed
a CPM schedule, developed progress tracking methodologies and monitored
and negotiated the cost of the project with the general contractor and
various subcontractors.
